Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Trainpath. By creating an account or using the platform, you agree to be bound by these Terms.

1. The service

Trainpath is a software-as-a-service platform for personal trainers, coaches, and gym owners to manage clients, deliver workouts, schedule sessions, accept payments, and run their coaching business. We may add, change, or remove features from time to time.

2. Eligibility and accounts

  • You must be at least 16 years old to create an account.
  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • You must provide accurate registration information and keep it up to date.

3. Trainer responsibilities

If you use Trainpath as a trainer or business owner:

  • You are responsible for the coaching, programming, and advice you deliver to clients.
  • You must obtain informed consent from clients before adding them, and ensure they are medically cleared to train.
  • You are the data controller for client data you collect; we are the data processor (see Privacy Policy).
  • You must comply with all laws applicable to your business (consumer protection, tax, professional licensing, etc.).

4. Client responsibilities

If you use Trainpath as a client:

  • Workouts, nutrition guidance, and any other content provided by your trainer are not medical advice. Consult a qualified medical professional before starting any program.
  • You use exercises and recommendations at your own risk.
  • You may withdraw consent for processing of your data at any time by contacting your trainer or us.

5. Payments and fees

  • Trainers may sell services through Trainpath; payments are processed by Stripe.
  • Platform fees, transaction fees, or subscription charges may apply, as disclosed in your dashboard or pricing page.
  • Refunds are at the trainer's discretion unless required by law. Disputes between trainers and clients should be resolved directly between them.

6. Acceptable use

You agree not to:

  • Use Trainpath for unlawful, harmful, or fraudulent purposes.
  • Upload content that is harassing, defamatory, infringing, or in breach of someone else's privacy.
  • Reverse engineer, scrape, or attempt to gain unauthorised access to the platform.
  • Resell or sublicense access without our written permission.

7. Content ownership and licence

You retain ownership of content you upload (workouts, programs, photos, posts). You grant us a worldwide, non-exclusive licence to host, store, and display that content solely to operate the service. You are responsible for having the rights to any content you upload.

8. Suspension and termination

We may suspend or terminate accounts that violate these Terms or that pose a security or legal risk. You may close your account at any time. Some sections of these Terms (Sections 7, 9, 10, 11) survive termination.

9. Disclaimers

The platform is provided “as is” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted availability, error-free operation, or specific outcomes from using the service. Coaching content delivered through Trainpath is not medical advice.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to your use of Trainpath will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) A$100. We are not liable for indirect, incidental, special, or consequential damages.

11. Governing law

These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria, Australia, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

12. Changes to these Terms

We may update these Terms periodically. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
